Terms and Conditions of Sale
Seller: UAB „ALBRIKAI", Beržų g. 1, Kuršėnai, Lithuania, VAT no. LT100005934012, e-mail a.albrikas@gmail.com, tel. +370 614 74185 (the Seller). These terms (the Terms) govern the purchase and sale of goods in the online store albrikai.cloudpepper.site.
1. General provisions
1.1. By placing an order the Buyer confirms having read and accepted these Terms. 1.2. Purchases may be made by legally capable natural persons and by legal entities. 1.3. The contract is concluded when the Seller sends an order confirmation to the Buyer by e-mail.
2. Prices and payment
2.1. Prices are stated in euros, VAT included. Delivery charges are shown separately at checkout. 2.2. Payment is made by online banking or payment card via the „Montonio" payment platform. 2.3. Order processing starts upon receipt of payment.
3. Delivery
3.1. Goods are delivered via Omniva, DPD or Venipak parcel lockers and couriers; free collection at the Seller's premises is also available. 3.2. The usual delivery time in Lithuania is 2–5 business days from payment. 3.3. Oversized goods (e.g. diver propulsion vehicles) are delivered by courier. 3.4. On receipt, the Buyer must inspect the shipment and report any damage to the Seller within 3 business days.
4. Right of withdrawal (14 days)
4.1. A consumer Buyer may withdraw from a distance contract without giving any reason within 14 days of receiving the goods (Art. 6.228-10 of the Civil Code of Lithuania) by notifying a.albrikas@gmail.com. 4.2. The goods must be returned within 14 days of the notice; the direct cost of returning the goods is borne by the Buyer. 4.3. The Seller refunds all payments received (including standard delivery costs) no later than 14 days after receiving the notice, but may withhold the refund until the goods or proof of their dispatch are received. 4.4. The right of withdrawal does not apply in the cases listed in Art. 6.228-10(2) of the Civil Code (e.g. goods made to the consumer's specifications, sealed hygiene-sensitive goods that have been unsealed, etc.).
5. Quality guarantee and returns of defective goods
5.1. Goods are covered by the statutory 2-year quality guarantee (Art. 6.338 of the Civil Code); manufacturer (SUEX, Scubapro) warranties apply under their own conditions. 5.2. For defective goods the Buyer may request free repair or replacement, a corresponding price reduction, or a refund (Arts. 6.363–6.364 of the Civil Code). 5.3. Returned goods must be accompanied by proof of purchase.
6. Equipment rental
6.1. Rental equipment is reserved on the website by selecting dates and paying the rental price. 6.2. The Buyer is responsible for the condition of the rented equipment during the rental period and must return it complete and in the same condition. 6.3. Deposit, damage and late-return conditions are specified when the equipment is handed over.
7. Personal data
7.1. Personal data is processed in accordance with our Privacy Policy and Cookie Policy.
8. Liability and final provisions
8.1. The parties are released from liability in force majeure circumstances. 8.2. These Terms are governed by the law of the Republic of Lithuania. 8.3. Disputes are resolved by negotiation; failing that, a consumer Buyer may apply to the State Consumer Rights Protection Authority (Vilniaus g. 25, Vilnius, www.vvtat.lt), use the EU ODR platform at ec.europa.eu/odr, or bring the dispute before the courts of the Republic of Lithuania.
